1. Provider and contact

KeepAround is provided by PurposelySimple, operated by Tim Claus. Contact: purposelysimple@icloud.com

2. Purpose and use of the app

KeepAround is a tool for saving, structuring, analyzing, searching and retrieving information that you choose to submit to the app. You are responsible for using KeepAround lawfully and in accordance with these Terms and the rules of the Apple App Store.

3. Your content and third-party rights

You decide which links, files, text, notes and other content you save. You must have the rights or another lawful basis required to import, process, store, export and, when applicable, share it. KeepAround may not be used to bypass logins, paywalls, copy protection, access restrictions or third-party rights.

You retain rights in your own content. Rights in external sources, trademarks, works and services remain with their respective owners. KeepAround is not affiliated with or endorsed by external platforms unless explicitly stated otherwise.

4. Automatic analysis and no guarantee of accuracy

Summaries, facts, topics, relationships, search results, assistant answers and other automatically generated content may be incomplete, outdated or incorrect. They are aids for finding and understanding your own library, not a guarantee of fact. Always verify important statements against the original source.

5. No professional advice

KeepAround does not provide medical, legal, tax, financial, safety or other professional advice. Do not make important decisions based solely on automatically generated content. Consult a qualified professional when appropriate.

6. Data, iCloud and external services

You decide what data you enter into KeepAround and which Apple permissions you grant. iCloud synchronization, Private Cloud Compute, the App Store and StoreKit are provided by Apple and may depend on your Apple Account, device, operating system, region, language, network, storage and settings. External sources may change, restrict content or disappear. PurposelySimple does not control those services or sources.

iCloud synchronization is not a user-controlled backup. Use the export feature in app settings for important data. You are responsible for appropriate backups and for protecting your device and Apple Account.

7. In-app purchases and subscriptions

The free plan lets you save up to and including 50 active memories. KeepAround Plus removes this limit and is offered as an auto-renewable annual subscription. Memories you already saved remain readable, searchable, correctable, exportable and deletable after expiration or cancellation.

The Apple App Store displays the price and billing period before purchase. Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically for another year unless you cancel at least 24 hours before the end of the current period. Renewal is charged within 24 hours before the period ends. You can manage or cancel the subscription through your Apple Account or the App Store subscription management page. Refunds follow Apple's procedures and mandatory legal rights.

8. Support

KeepAround is a small independent project provided without a staffed support desk. There is no guaranteed response time and, to the extent permitted by law, no entitlement to individual assistance. Self-help information is available on the Support page. For app issues, privacy requests or legally required contact, email purposelysimple@icloud.com.

9. Availability, changes and discontinuation

KeepAround may be changed, expanded, restricted or discontinued. Features may be temporarily or permanently unavailable. To the extent permitted by law, there is no entitlement to uninterrupted, error-free or permanent availability of individual features. Mandatory rights under an ongoing paid contract remain unaffected.

10. Intellectual property

The app, design, text, name, logo and other KeepAround content belong to PurposelySimple or their respective rights holders. You receive a personal, revocable, non-exclusive and non-transferable right to use the app under these Terms and the Apple App Store rules. Reverse engineering and reuse are permitted only where mandatory law allows them.

11. Liability

PurposelySimple remains fully liable for intent and gross negligence; injury to life, body or health; mandatory product liability; and any other liability that cannot lawfully be excluded.

For a slightly negligent breach of an essential contractual duty, liability is limited to damage that was foreseeable and typical for the contract when it was formed. Liability for other slight negligence is excluded to the extent permitted by law.

To the extent permitted by law, PurposelySimple is not liable for indirect loss, lost benefits, incorrect or incomplete automatic content, data loss, missing backups, unavailable sources, failures or changes of external services, network interruptions, device settings, or unlawful or improper use. Mandatory warranty, consumer and refund rights remain unaffected.

12. Apple notice

Apple is not a party to these Terms. Download, purchase and use through the App Store are also subject to Apple's applicable terms. Apple's standard end-user license agreement remains unaffected where it applies mandatorily or additionally.

13. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protections in your country of habitual residence and statutory jurisdiction rules remain unaffected.

14. Changes to these Terms

These Terms may be updated for the future when KeepAround, legal requirements or App Store requirements change. Material changes will be communicated in an appropriate manner. Changes to existing paid contracts apply only to the extent permitted by law.
